Agreement to Terms

By accessing or using the website malyinternetmarketing.com ("Site") or engaging our services, you agree to be bound by these Terms of Service ("Terms"). Services

Maly Internet Marketing provides web design, development, search engine optimization (SEO), pay-per-click advertising (PPC), AI chatbot integration, lead generation systems, and related digital marketing services. The specific scope, deliverables, and pricing for each engagement will be outlined in a separate written proposal or agreement between us and the client.

We reserve the right to modify, update, or discontinue any of our services at any time, with reasonable notice to active clients.

Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information necessary for us to perform our services
• Respond to requests for content, feedback, and approvals in a timely manner
• Ensure that any content, images, or materials you provide do not infringe on third-party intellectual property rights
• Maintain the confidentiality of any account credentials we provide
• Make payments according to the agreed-upon schedule

Payment Terms

Payment terms are specified in each client's individual proposal or service agreement. General terms include:

• One-time setup fees are due prior to the start of work, unless otherwise agreed
• Monthly service fees are billed at the beginning of each service period
• Invoices are due within 15 days of receipt unless otherwise specified
• Late payments may incur a fee of 1.5% per month on outstanding balances
• We reserve the right to suspend services for accounts with overdue balances exceeding 30 days

Intellectual Property

Your Content

You retain ownership of all content, text, images, logos, and materials you provide to us. By providing these materials, you grant us a license to use them solely for the purpose of delivering our services.

Our Work

Upon full payment, you own the custom website design, content we create for you, and associated deliverables. We retain the right to display your project in our portfolio and marketing materials unless you request otherwise in writing. We retain ownership of proprietary tools, code libraries, frameworks, and systems that we use across multiple client projects.

Website Hosting & Maintenance

If your plan includes hosting and maintenance, we will make reasonable efforts to keep your website available and up to date. However, we do not guarantee 100% uptime and are not liable for downtime caused by factors beyond our control, including but not limited to server outages, cyberattacks, natural disasters, or third-party service failures.

Third-Party Services

Our services may involve the use of third-party platforms, tools, and services (e.g., Google Ads, Google Analytics, email marketing platforms, AI tools). We are not responsible for the terms, policies, or performance of these third-party services. Any fees charged by third-party platforms (such as advertising spend) are your responsibility unless otherwise agreed.

No Guarantees of Results

While we strive to deliver measurable results, digital marketing outcomes depend on many factors beyond our control, including market conditions, competition, seasonal trends, and search engine algorithm changes. We do not guarantee specific rankings, traffic levels, or lead volumes. Any projections or estimates we provide are based on our experience and are not binding commitments.

Limitation of Liability

To the fullest extent permitted by law, Maly Internet Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Site or services, including but not limited to loss of revenue, data, or business opportunities. Our total liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Termination

Either party may terminate monthly services with 30 days written notice. Upon termination:

• Any outstanding invoices become immediately due
• We will provide you with all deliverables completed up to the termination date
• We will assist with a reasonable transition of your website and accounts to your chosen provider
• Access to ongoing services (hosting, AI tools, etc.) will end at the conclusion of the current billing period

Use of Website

When using our Site, you agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Site
• Interfere with the Site's functionality or security
• Reproduce, distribute, or modify our content without written permission
• Use automated tools to scrape or harvest data from our Site

Indemnification

You agree to indemnify and hold harmless Maly Internet Marketing and its owner, employees, and agents from any claims, damages, or expenses arising from your use of our services, your breach of these Terms, or your violation of any third-party rights.

SMS/Text Messaging Terms

By providing your mobile phone number on our contact form and checking the SMS consent box, you agree to receive text messages from Maly Internet Marketing. These messages may include responses to your inquiries, appointment reminders, service follow-ups, and consultation-related communications.

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located in Kendall County, Illinois.
